1. Business information
ELITE CONDITIONING, sole proprietorship for sports instruction and conditioning, owned by Ivica Klunić
Kranjčevićeva 3, 52100 Pula, Croatia
OIB: 89770027041
E-mail: info@elite-conditioning.hr
The business is not registered for VAT.
2. Scope
These terms apply to products and services provided and billed by Elite Conditioning: digital guides, online coaching, individual and group training, consultations, education and webinars where Elite Conditioning is named as seller, and its own services within online communities.
Elite Lifestyle Club and Football Game Ready are available on Skool. When membership is purchased and billed directly on that platform, its terms also apply. Services and products sold by the separate business MMPERFORMANCE are subject to the MM Performance terms. The seller of a webinar is identified with the offer and on the invoice, regardless of who presents it.
3. Digital products
Digital products include PDF guides and other digital materials shown on the product pages, including:
- Better Fitness Without Extremes
- Parents of Young Athletes
- Guide to Developing Young Footballers
- Strength and Conditioning Methods in Football.
Each product page sets out the description, content, price and any bonuses. Product images and previews may be illustrative.
4. Prices, payment and contract formation
Prices are in euros unless an offer expressly states another currency. Elite Conditioning is not registered for VAT. The price, content and delivery method are shown before a payment obligation arises. Digital guides and certain webinars are paid by card through Stripe Checkout; other services are agreed and paid according to the relevant offer. Skool memberships are paid under the terms displayed on that platform.
A separately signed agreement is not required for a distance purchase. For a direct online purchase, the buyer confirms an order with an obligation to pay in the checkout interface; for an individually arranged service, the offer is accepted as specified in it. The buyer provides accurate details needed for delivery and invoicing. The invoice is delivered electronically. Required information about the concluded contract is provided on a durable medium no later than delivery or the start of the service.
Buyers may be consumers, sole traders, clubs or other legal entities. Specific consumer rights apply to a buyer who qualifies as a consumer under law.
5. Delivery of digital content
After successful payment, the digital product is sent to the email address entered at checkout via a download link. Delivery is expected immediately and no later than 15 minutes, except in the event of a technical issue.
If the product does not arrive, the buyer should check the spam folder and the email address entered and contact info@elite-conditioning.hr. Elite Conditioning will check the transaction and resend the correct link.
6. Withdrawal from a digital product purchase and refunds
A consumer may withdraw from a digital product purchase without giving a reason within 14 days of entering the contract, even if the product has already been delivered or downloaded. It is enough to send the request before the deadline by email to info@elite-conditioning.hr or by post to the business address in section 1. Include your name, the email used for the purchase and the product name or order number. You may use the sample withdrawal statement, but this is optional.
On receipt of a valid withdrawal statement, we refund the amount paid without undue delay and no later than 14 days after receipt, generally using the same payment method as the purchase. Card refunds are initiated through Stripe; when the refund appears in your account depends on the payment provider. We do not require the buyer to waive other statutory rights to obtain a refund.
If you withdraw, your right to use or further share the digital content ends. Rights relating to non-delivery, defects or non-conformity remain in force independently of this withdrawal right.
6.a Sample withdrawal statement
To: ELITE CONDITIONING, owned by Ivica Klunić, Kranjčevićeva 3, 52100 Pula; info@elite-conditioning.hr
I, [full name], hereby withdraw from the contract for [product or service name], entered into on [date]. My contact details: [address and email]. Date sent: [date]. Signature: [only if sent on paper].
You do not have to use this sample. A clear statement sent within the statutory deadline is sufficient.
7. Defects, non-delivery and incorrect charges
The buyer's statutory rights are unaffected. Report problems without undue delay to info@elite-conditioning.hr.
- If a link does not work or a file is damaged, a working link or file will be provided.
- If a product was not delivered, it will be resent after payment is verified.
- If the same purchase was incorrectly charged twice, the excess will be refunded after verification.
- If the digital content does not conform to the contract, the buyer has the rights provided by applicable law.
These situations are distinct from a voluntary refund for a change of mind.
8. Licence and permitted use
Purchase grants a limited, non-exclusive, non-transferable right to use the digital product personally or internally. The buyer does not acquire copyright or other ownership rights.
Unauthorized sharing, resale, public posting, copying, modification for further distribution, uploading to shared repositories or using the content to create a competing product is prohibited without prior written permission.
When a company, club or sole trader buys one copy, the licence covers one person unless a team or organizational licence is agreed in writing.
9. Coaching, training and consultations
For online coaching, individual or group training and consultations, an interested person sends an enquiry. The content, number of sessions or duration, price, payment and program start are agreed before work begins. Details are confirmed in an offer and its acceptance; the invoice is sent separately. If monthly continuation is agreed, renewal and cancellation arrangements must be clear before payment.
Training work begins with an assessment of needs and, where needed, a questionnaire about health, injuries, training and nutrition. The client provides complete and accurate information and reports changes relevant to safe training.
Session cancellation, pauses, communication, program schedule and termination may be specified in the individual offer before acceptance. The individual arrangement governs that collaboration, subject to mandatory consumer rights. A consumer who contracts for a service at a distance may generally withdraw within 14 days of entering the contract by sending a clear statement to info@elite-conditioning.hr or by post to the address in section 1. If the consumer expressly requests that the service begin before that period ends and then validly withdraws, they may have to pay a proportionate amount for the service actually provided, where statutory conditions are met. Starting three-month coaching does not itself remove the withdrawal right; that right can end because of performance only after full completion of the service, with the consumer's prior express consent and acknowledgement of that consequence.
9.a Webinars and education
Before each webinar or educational event is purchased, the topic, format, date for a live event, included content, recording access if any, total price and invoicing business are specified. When Elite Conditioning sells a webinar, these terms apply even if another person presents it. MMPERFORMANCE's terms apply to webinars it sells.
If Elite Conditioning cancels an event, the buyer is offered another date with their agreement or a refund. The digital-content rules in section 6 apply to recordings and other digital materials; relevant legal rules and pre-purchase information apply to live services.
10. Health and professional information
Content, digital products and coaching are for education and training. They are not a medical diagnosis, treatment or substitute for examination by a doctor or another qualified health professional.
Stop the activity and seek professional advice if you experience unusual pain, dizziness, breathing difficulties or other concerning symptoms. People with an illness, injury, pregnancy, medical treatment or another special condition should consult an appropriate health professional before making significant changes to activity or diet and inform the coach of limitations relevant to safe training. The client exercises within their abilities, the agreed program and the instructions given, and stops immediately if concerning symptoms arise. In online coaching, the client exercises independently without the coach's direct physical supervision. The client is responsible for proper technique, suitable conditions and functioning equipment; if an exercise or instruction is unclear, ask for clarification before continuing.
11. Minors
A service for a minor may be contracted only with prior consent from a parent or legal guardian. The parent or guardian is responsible for entering the contract, providing accurate information and communicating about the service.
12. Skool communities and other platforms
Elite Lifestyle Club and Football Game Ready are available through Skool. Skool may manage payment, user accounts, access and technical functions under its own terms.
Elite Conditioning is not responsible for outages, feature changes or platform decisions beyond its reasonable control. It remains responsible for the content and obligations it provides directly under the applicable contract and law.
13. Intellectual property
Website content, programs, text, videos, visuals, guides, methods and other materials are protected by copyright and other rights. They may not be used outside the permitted licence without written authorization.
14. Liability
Elite Conditioning provides content and services with professional care but does not guarantee a particular athletic, aesthetic, health or business result, as outcomes depend on many factors beyond the provider's control.
In online coaching, the client assumes responsibility for independent execution of exercises. Elite Conditioning is not liable for injury or damage caused by improper technique, failure to follow instructions, faulty equipment, withholding significant health limitations or independently changing the program, where the damage did not result from an act or omission of Elite Conditioning. Acceptance of these terms confirms that the client is aware of the rules for independent exercise; it does not exclude Elite Conditioning's liability for its own harmful act or omission.
Nothing in these terms excludes or limits liability where doing so is prohibited by law or reduces mandatory consumer rights.
15. Written consumer complaints
A written complaint may be sent to info@elite-conditioning.hr or by post to the business address in section 1. Include your name, the product or service, purchase date and a description of the issue where possible.
We respond to written complaints in writing within 15 days of receipt, stating whether we consider the complaint justified.
16. Force majeure and technical difficulties
We are not responsible for a delay or inability to perform caused by an event beyond reasonable control, but will take reasonable steps to minimize its effects and fulfil the obligation as soon as possible.
17. Governing law and disputes
These terms are governed by the law of the Republic of Croatia, subject to mandatory consumer rights that cannot be excluded by contract.
The parties will seek to resolve disputes amicably. A consumer may use available alternative consumer dispute resolution mechanisms or apply to the competent court.
18. Changes to the terms
These terms may be updated due to changes in services, technology or law. A purchase is governed by the version available when the contract was entered into, unless the law requires otherwise.
