General Terms and Conditions
Effective date: January 2, 2025.
These terms of sale outline the procedures for ordering, payment, delivery, and the processes for returning or lodging complaints regarding the services offered on our website. The supplier (Seller) is ELITE CONDITIONING, a sports training and preparation enterprise owned by Ivica Klunić, located at Kranjčevićeva 3, Pula. The customer of the service is any individual who purchases a service through the online store in accordance with the Payment Methods, specifically by selecting the service, initiating the payment process via the checkout, and remitting payment through a credit or debit card to the Seller's bank account, or by bank transfer (payment slip) at a bank (post office, FINA, m-banking, or internet banking), and subsequently sending the order to the Seller, or by sending the order and opting for payment upon delivery (cash on delivery).
Through the website https://web.elite-conditioning.hr, customers can purchase the services offered on the Seller's site.
ELITE CONDITIONING is exempt from VAT.
The currency is the Euro (EUR).
ELITE CONDITIONING, a sports training and preparation enterprise owned by Ivica Klunić, located at Kranjčevićeva 3 in Pula, is not subject to VAT.
Ordering
The service is available for order 24 hours a day, 7 days a week. Orders are placed using an electronic form. If the seller is unable to fulfill the entire order, they will deliver the items they can and will inform the Buyer in writing of the delivery date for the remaining items.
The customer has the option to accept or cancel the service delivery. If the customer lacks an email address, they will be notified via phone.
Returns and grievances
These Terms and Conditions, along with specific terms of sale pertaining to certain products, constitute an offer by Elite Conditioning for the establishment of a Contract. The user, as the buyer, accepts these terms by registering, placing an order, or through other means as outlined in these Terms, which is regarded as the formation of a Contract between the user and Elite Conditioning, in accordance with the terms of sale detailed herein.
The subject and commercial intent of the Contract pertains to the acquisition of the chosen service through the Elite Conditioning web shop, accompanied by the payment of the requisite fee—namely, the price of the specified product or service. The Contract is established through distance communication (Distance Contract) and is finalized via: printed promotional materials featuring an order form, telephone communication with or without human involvement, and the Internet.
The contract takes effect and becomes binding upon the user's acceptance of Elite Conditioning's offer through one of the following methods:
by selecting payment and completing the order as a registered user at https://web.elite-conditioning.hr, or by selecting payment and completing the order as a guest user at https://web.elite-conditioning.hr. a) During the registration or creation of a user account, the user is required to select a username under which they will utilize the services, choose a secure password, and provide a valid email address. All information necessary for registration or account creation must be accurate, and the use or exploitation of another individual's data is strictly prohibited.
b) A registration or user account is established for a single individual only, and sharing registration or user account information with third parties is prohibited. The user is responsible for maintaining the confidentiality of their security password and user account details. Utilizing another person's registration or user account is not allowed.
c) In the event of a breach of the provisions outlined in the Terms and Conditions of this chapter, Elite Conditioning retains the right, at its sole discretion, to terminate the user's registration or account, without any obligation to compensate the user for costs or damages incurred.
d) Registration, which encompasses payment for the service, is regarded as a contract between Elite Conditioning and the user as the purchaser.
e) The Agreement becomes effective upon the completion of the user's registration or from the date the user accepts the offer to enter into such an Agreement.
f) Upon the conclusion of the Contract, the User will receive: a confirmation of the finalized Contract, specifically a pre-contractual notice as outlined in Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), these Terms and Conditions, and a notification regarding the User's right to unilaterally terminate the Contract, accompanied by a form for unilateral termination as specified in Article 61, paragraphs 1 and 2 of the Consumer Protection Act.
g) The User may unilaterally terminate the Agreement within fourteen (14) days without providing any justification. The User does not possess the right to unilaterally terminate the Agreement:
If the service has been fully rendered, and the performance has commenced with the individual's explicit prior consent, along with their acknowledgment that they will forfeit the right to unilaterally terminate the Contract upon full performance, this applies in cases where the subject of the Contract involves sealed goods that are non-returnable for health or hygiene reasons if unsealed after delivery; goods that, by their nature, are inseparably mixed with other items post-delivery; sealed audio or video recordings, or computer programs that have been unsealed after delivery; or the delivery of books, newspapers, periodicals, or magazines. To exercise the right to unilaterally terminate the Contract, the user must notify Elite Conditioning of their decision prior to the expiration of the deadline through a clear statement sent by post (to ELITE CONDITIONING, sports training and preparation trade, owned by Ivica Klunić, Pula, Kranjčevićeva 3) or via email at info@elite-conditioning.hr, including their name, address, telephone number, fax number, or email address.
The deadline for unilateral termination of the Contract is fourteen (14) days from the date on which the goods subject to the Contract are delivered to the user or a third party designated by the user, who is not the carrier, or in the case of a service, from the conclusion of the Contract.
If the user unilaterally terminates the Agreement, any funds received from them, including delivery costs, will be promptly refunded, no later than 14 (fourteen) days from the date Elite Conditioning receives the user's notice of termination, unless the user has selected a delivery method that is not the least expensive standard option available. The refund will be processed using the same method as the original payment. Should the user agree to an alternative refund method, they will incur no costs associated with the refund. Elite Conditioning will issue the refund only after the goods have been returned or upon receipt of proof that the goods have been dispatched back.
The user is required to return the goods or send them to the address ELITE CONDITIONING, obrt za sportsku poduku i preparaciju, vl. Ivica Klunić, Pula, Kranjčevićeva 3, without undue delay, and in any event no later than 14 (fourteen) days from the date on which Elite Conditioning communicated its decision regarding the unilateral termination of the Contract. The user is responsible for the direct costs associated with the return of the goods. The user is encouraged to contact info@elite-conditioning.hr prior to termination to receive clarification on the procedure for returning the goods.
The user is accountable for any reduction in the value of the goods arising from their handling, except for actions necessary to ascertain the nature, characteristics, and functionality of the goods.
If, at the user's request, the service performance has commenced during the period for unilateral termination of the Agreement, the user is obligated to compensate Elite Conditioning an amount proportional to the services rendered up to the point when the user notified Elite Conditioning of the unilateral termination of the Agreement.
h) In the case of material defects, the seller is responsible for such defects in the items sold on its website, in accordance with applicable regulations, particularly the Civil Obligations Act of the Republic of Croatia.
In the event of a visible defect in the product upon receipt of the shipment (e.g., damage to the packaging), the buyer is not obligated to accept the delivered product, may refuse receipt, and shall not be liable for the costs associated with the delivery of such a product. Products that have been properly received by the buyer are deemed to have no visible defects.
If the product exhibits a concealed defect (e.g., the product is damaged, or it has scratches resulting from transportation or improper storage) that the buyer identifies upon opening the product without utilizing, assembling, or activating it, and which is confirmed by an authorized service, the buyer is entitled to unilaterally terminate the contract and receive a refund, request a replacement, rectify the defect, or negotiate a price reduction.
Products covered by a warranty in accordance with legal requirements and the manufacturer's specifications are accompanied by a warranty certificate. The right to utilize the warranty is contingent upon the presentation of both the invoice and the warranty certificate. The buyer is responsible for retaining the warranty certificate and invoice. The invoice date marks the commencement of the warranty period. The product description includes details regarding the duration of the warranty for each specific product.
In instances where a warranty certificate is issued, affirming the manufacturer's guarantee of the product's accuracy for a specified duration, the buyer may request repairs within a reasonable timeframe if the product is found to be defective. Alternatively, the buyer may opt for the delivery of a replacement product instead of repair. Should a malfunction arise during the warranty period, the product must be taken to the authorized service center indicated in the warranty certificate.
The right to utilize the warranty is contingent solely upon the presentation of the invoice. The purchaser is required to retain both the warranty card and the invoice. Product malfunctions arising from improper use and/or noncompliance with the provided instructions are excluded from warranty coverage. Maintenance and the sale of replacement parts for the purchased product are facilitated through authorized service centers specified in the warranty card.
Order Confirmation
The Buyer will receive an order confirmation notification via e-mail upon completion of the purchase, which includes all legally mandated details.
