1. Who processes your data
This website presents two separate businesses. The controller of data relating to Ivica's offers is ELITE CONDITIONING, sole proprietorship for sports instruction and conditioning, owned by Ivica Klunić, Kranjčevićeva 3, 52100 Pula, Croatia, OIB: 89770027041. The controller of data relating to Marko's offers is MMPERFORMANCE, sole proprietorship for consulting and services, owned by Marko Matušinskij, Industrijska 14, 32100 Vinkovci, Croatia, OIB: 57015916381. For privacy questions or requests, email m.matusinskij@gmail.com or write to the postal address above. For service enquiries you can also use Marko's Instagram profile.
The business named with a form receives its submissions. Purchase data belongs to the business identified as seller in the offer and invoice. For shared content, the receiving business is identified before registration or payment; the other business does not automatically receive the data.
2. What data we process
Depending on whether you use the site, complete a form, download material, buy a product, apply for mentorship or enter coaching, the relevant business may process:
- identification and contact details: name, email, phone, date of birth, address and Croatian personal identification number (OIB) when needed for an invoice
- purchase, payment, invoice, digital delivery and refund request data
- communications by email, Facebook Messenger, video call and other agreed channels
- questionnaire and assessment data: goals, training, dietary habits, weight, body measurements, results and progress photos
- information about injuries, illnesses, medication and other health circumstances you provide for safe and appropriate coaching, based on explicit consent requested in the questionnaire
- data and reports shared through UltraX, Garmin, MyFitnessPal, Google Forms or Google Drive when the relevant business uses them for your service
- technical website usage data, such as IP address, device, browser and cookies, when such tools are enabled.
3. Purposes and legal bases for processing

4. Recipients and external services
Each business uses providers needed for its activities. Data of Marko's clients and applicants does not automatically enter Ivica's database, or vice versa. Depending on the service, data may be shared with, for example:
- Stripe for card payment and refund processing
- e-Računi and competent authorities for issuing and fiscalizing invoices
- Make when used to automate delivery and business processes
- Zoho Mail i MailerLite for email communications and, where there is a suitable basis, newsletters
- Skool for access to the Elite Lifestyle Club and Football Game Ready communities
- Meta/Instagram i Facebook Messenger for conversations initiated by a person on these platforms
- UltraX, Garmin i MyFitnessPal when you use them as part of coaching
- Google Forms i Google Drive for questionnaires, applications, free materials, documents and data exchange; each form identifies the business receiving its data
- hosting, maintenance, analytics and advertising providers when used on the website.
These providers may act as processors or independent controllers under their own privacy policies.
5. Transfers outside the European Economic Area
Some providers may process data outside the European Economic Area. In those cases, transfers use appropriate safeguards, such as a European Commission adequacy decision, standard contractual clauses or another mechanism permitted by data protection law.
6. Retention periods
- Ivica's coaching data, questionnaires, results, photographs, videos and communications: generally up to 2 years after the collaboration ends, unless a need or legal obligation requires longer retention
- invoices, accounting and tax documents: for the periods required by applicable law
- purchase and delivery data: for as long as needed to perform the contract, provide support, document the transaction and protect legal claims
- marketing data: until consent is withdrawn or you unsubscribe
- enquiry and application data where no collaboration begins: only as long as needed to respond, process the application and reasonably follow up. Application and free-material data is retained according to the purpose and information given with the relevant form.
Data may be kept longer for a legal claim, dispute, audit or other legal obligation. If health data is processed on the basis of consent, withdrawal stops future processing on that basis unless another applicable legal basis permits limited retention.
7. Minors
Online coaching is primarily intended for adults. When a service is provided to a minor, prior consent from a parent or legal guardian is required, and data is processed only as needed for the agreed service and the athlete's safety.
8. Cookies, analytics and advertising
This website uses essential technologies for basic functionality and to remember privacy choices. Google Analytics 4 is used only with your consent to analytics cookies to measure visits, pages used and clicks on important links.
With your consent to marketing cookies, we use Meta Pixel to measure visits and ad effectiveness and build audiences on Meta platforms. Google Analytics and Meta Pixel are not activated before the relevant consent. You may reject or later change consent via the link Cookie settings in the footer. Details are in the Cookie Policy.
9. Your rights
Depending on the circumstances, you may request access to, correction or deletion of data, restriction of processing, data portability and object to processing. Where processing is based on consent, you may withdraw it at any time without affecting processing carried out before withdrawal.

For data processed by MMPERFORMANCE, send your request to m.matusinskij@gmail.com or write to Industrijska 14, 32100 Vinkovci. To protect your data, we may ask you to verify your identity. If you contact the other business, we will help direct your request without unnecessary disclosure.
You have the right to lodge a complaint with the Croatian Personal Data Protection Agency (AZOP).
10. Data security
We use reasonable technical and organizational safeguards, including restricted access, protection of accounts and devices, reputable providers and data minimization.
11. Third-party links and platforms
The site links to Stripe, Skool, Instagram, Google Forms and other external platforms. Their terms and privacy policies apply when you use them. Each business is responsible for its own processing related to its services, while the platforms have their own privacy policies.
12. Changes to this policy
We may update this policy to reflect changes in services, technology or law. The updated version will be published here with its revision date.
