1. Business information
MMPERFORMANCE, sole proprietorship for consulting and services, owned by Marko Matušinskij
Industrijska 14, 32100 Vinkovci, Croatia
OIB: 57015916381
E-mail: m.matusinskij@gmail.com
The business is not registered for VAT. Quotes and invoices are issued in the name of MMPERFORMANCE.
2. Services covered by these terms
These terms apply when MMPERFORMANCE is identified as the provider and billing business: individual and online training, assessment and advice, consultations, mentorship, individual education modules, webinars organized and billed by MMPERFORMANCE, and specific editions of Performance Camp.
This website also presents the services of the separate business Elite Conditioning. Purchases from that business are governed by the Elite Conditioning terms. A presenter, mentor or person featured on a shared page does not by itself determine the seller; the information attached to the specific offer, application, payment method and invoice does.
3. Offers, applications and contract formation
The website descriptions and price list provide an overview of services and prices. Before taking on a payment obligation, the client receives details of the exact service, its content, duration, price, any additional charges, payment method, start date, venue or delivery method and cancellation terms. An individual offer or application confirmation may specify further details and takes precedence for that service, subject to mandatory consumer rights.
Sending an enquiry or Google Form does not itself mean acceptance or create an obligation to pay. A contract is formed after MMPERFORMANCE confirms availability and specific terms and the client accepts them as described in the offer. If payment is needed to reserve a place, the method and deadline are clearly stated before acceptance.
4. Prices, payment and invoice
Prices are in euros. MMPERFORMANCE is not registered for VAT. The final price, any additional charges and available payment method are specified in the offer or before an online order is confirmed. Payment is made using the method offered for that service.
MMPERFORMANCE issues invoices for services it bills. Where Elite Conditioning is named as seller, its terms apply and it issues the invoice. The client provides accurate information needed to deliver the service and issue the invoice.
5. Individual sessions and monthly packages
The number, frequency, duration, location, delivery and start date of a monthly package are confirmed before payment. Additional services, including physiotherapy where included, are set out in the offer; two physiotherapy sessions and, where included, two additional individual sessions are per month, not per week. Physiotherapy is provided only by an appropriately qualified person or provider as specified in the offer.
The monthly package applies for the agreed period and does not renew automatically. The following month requires a new agreement and payment. Unused sessions do not automatically carry over; any make-up session depends on the cancellation rule and the specific offer.
6. Cancelling and rescheduling individual sessions
The client may cancel or reschedule an agreed individual training session, assessment or consultation without an additional charge by notifying m.matusinskij@gmail.com at least 24 hours before the appointment. The new appointment depends on availability and is arranged with Marko.
A later cancellation or no-show generally counts as a used session if the slot was reserved and this was made clear when booking. An exception may be agreed in exceptional circumstances. If MMPERFORMANCE cancels, the client is offered a replacement appointment or a refund for the unprovided service. This rule does not limit any applicable statutory consumer withdrawal right.
7. Online programs and assessments
An online training program is designed and delivered for the scope, duration and communication channel stated in the offer. Assessment includes only the tests, report and consultation agreed in advance. The client provides accurate information about activity and limitations and promptly reports changes relevant to safe training. In online programs, exercises are performed independently without direct physical supervision; the client must follow instructions, ensure suitable conditions and functioning equipment, and seek clarification if an exercise is unclear.
Materials provided during a program are for the personal use of the person for whom they were created. Delivery times, support level and any meetings are specified before purchase.
8. Mentorship
Mentorship is a three-month program. Its content, meeting schedule, materials, mentor support and participation format are stated in the offer. The full list price is €1,200; where instalments are offered, there are three monthly payments of €400. Instalments are a way to pay for one three-month program, not three separate one-month subscriptions. Payment due dates and the program start date are stated before acceptance.
Withdrawal, ending participation or missing a meeting does not automatically erase obligations already incurred; statutory consumer rights, including withdrawal and calculation of any service already provided, take precedence. Any individual schedule adjustment is agreed in writing.
9. Education modules and webinars
Individual modules and webinars may be in person or online and may include recordings or digital materials. Before registration for each edition, the topic, presenter, date or time, format, included content, access to a recording if available, price and business issuing the invoiceare stated. When MMPERFORMANCE is the organizer and billing business, these terms apply; when Elite Conditioning is identified, its terms apply.
If an event is postponed or cancelled by the organizer, the participant is offered another date or a refund for the event not held. For events on a specified date, any different withdrawal rules must be clearly published before registration, subject to statutory rights.
10. Performance Camp
Performance Camp runs in separate editions. Before a binding registration, exact dates, venue, program, inclusions, number of places, participation conditions, payment method and cancellation or transfer rules are published. Registration may begin with a Google Form; sending an enquiry or form alone does not create an obligation to pay.
An edition may offer standard, Early Bird, student and Bring a Friend prices. Discount deadlines and terms, proof of student status and whether offers can be combined are stated before purchase. If the organizer cancels the camp, the participant is offered another date with their agreement or a refund. Mandatory consumer rights remain in force.
11. Consumer right of withdrawal
A consumer entering a distance contract may generally withdraw without giving a reason within 14 days of entering the service contract. The statement may be emailed to m.matusinskij@gmail.com or posted to the business address in section 1; sending it before the deadline is sufficient. The consumer may use the sample form below, but is not required to do so. Payments are refunded in accordance with statutory deadlines and rules.
If the consumer expressly requests that service begin before the 14 days expire and then validly withdraws within the period, they may owe a proportionate amount for service actually provided up to withdrawal, where statutory conditions are met. Once a service has been fully performed with the consumer's prior express consent and acknowledgement that this ends the withdrawal right, that right may cease. Separate rules apply to digital content supplied without a physical medium: payment or receipt of a link alone does not replace the required express consent, acknowledgement of loss of the right and contract confirmation.
The law provides an exception for certain leisure-related services contracted for a specific date or period. Whether it applies to a given camp or event depends on the actual content of that offer; participants will be clearly informed before contracting. No provision on dates, instalments or discounts excludes a statutory consumer right.
12. Sample withdrawal statement
To: MMPERFORMANCE, owned by Marko Matušinskij, Industrijska 14, 32100 Vinkovci; m.matusinskij@gmail.com
I, [full name], hereby withdraw from the contract for [service name], entered into on [date]. My contact details: [address and email]. Date sent: [date]. Signature: [only if sent on paper].
The statement may be worded differently as long as it clearly expresses the decision to withdraw.
13. Health, safety and minors
Training and educational content is not a medical diagnosis or substitute for examination or treatment. A person with an illness, injury, treatment or other limitation should seek advice from an appropriate health professional before starting activity and inform the service provider of significant limitations. Stop activity if unusual pain or other concerning symptoms occur. Do not continue an exercise unless you are confident you can perform it correctly and safely.
Services for minors are arranged with consent from a parent or legal guardian, who participates in the agreement, payment and provision of required details. Each camp edition will specify its intended audience and whether minors may participate.
14. Materials and intellectual property
Participants receive a non-transferable right to use the supplied educational or training materials for their own learning or personal work within the scope agreed at purchase. Public posting, resale, recording or distributing materials or access to others requires prior written permission from the rights holder. Participation does not transfer copyright to the participant.
15. Complaints and liability
A written complaint may be sent to m.matusinskij@gmail.com or by post to Industrijska 14, 32100 Vinkovci. Include your name, service, date and a description of the issue where possible. MMPERFORMANCE acknowledges receipt and responds in writing within 15 days of receipt, clearly stating whether it considers the complaint justified.
Services are provided with professional care, but no specific sporting, health or professional result is guaranteed. In online programs, the client assumes responsibility for independent execution. MMPERFORMANCE is not liable for injury or damage caused by improper technique, failure to follow instructions, faulty equipment, withholding significant health limitations or independently changing the program, where the damage did not result from an act or omission of MMPERFORMANCE. Acceptance confirms that the client understands the rules for independent exercise; it does not exclude MMPERFORMANCE's liability for its own harmful act or omission. These terms do not limit liability that cannot lawfully be limited or consumer rights for non-performance or defective performance.
16. Personal data, platforms and disputes
Personal data processing related to Marko's services, Google Forms and applications is governed by the Privacy policy. When external platforms are used for registration, education, payment or delivery, the relevant platform and its terms will be identified before use. MMPERFORMANCE remains responsible for its own obligations to the client.
These terms are governed by the law of the Republic of Croatia, subject to mandatory consumer rights. We will try to settle disputes by agreement; a consumer may apply to the competent court or an available alternative consumer dispute resolution body.
17. Changes to the terms
These terms may be updated. A specific purchase is governed by the terms available at the time the contract was entered into and confirmed with the offer, unless the law requires otherwise. A later update does not unilaterally change an agreed price or program content.
